• As per Prakash Singh Judgement, the DGP shall be selected by the State Government from amongst the three seniormost officers who have been empanelled by the Union Public Service Commission.

Provisions

  • Minimum tenure of at least two years, irrespective of date of superannuation.
  • There is no concept of an acting Director   General of   Police as per the decision in Prakash Singh’s case.
  • UPSC should empanel only those officers having at least two years of service left before retirement.
